Is There a Deadline to Probate a Will in New York?

People prepare estate planning documents so that the intended disposition of their assets is clearly expressed in an official document. Planning documents can include a Last Will and Testament and a Living Trust. There are also advance directives such as a Living Will, a Health Care Proxy and a Durable Power of Attorney. The New York Probate Lawyer Blog has published many articles concerning these documents.

With regard to a Last Will, I am occasionally asked if there is a deadline to probate a Will after someone dies. While there is no specific deadline, the Surrogate’s Court may request that an affidavit be filed explaining the reason for the delay. Any delay in estate settlement may result in damages or losses to a decedent’s estate. Assets may be compromised. For example, a real estate mortgage may go unpaid and the property might be foreclosed on.

Can an Old Will Still Be Valid in New York?

Another interesting issue that is often raised is whether a Will is still valid after many years. In fact, there is no time limit as to probating an old Will. Of course, problems may arise in locating attesting witnesses. These witnesses may be needed especially if there is a Will Contest or the Will does not have an Affidavit of Attesting Witnesses. Estates, Powers and Trusts Law Section 3-2.1 entitled “Execution and attestation of wills; formal requirements” provides the statutory requirements for signing a Will.

Recent Manhattan Estate Case: Will of John Henry Thomas III

Recently, there was a Manhattan estate case decided by Surrogate Hillary Gingold on September 24, 2026, entitled Will of John Henry Thomas III, in which a Will dated in 1963 was offered for probate. The decedent had died in 2023 and the estate was valued at approximately $4,800,000. Apparently, the Will was discovered in the decedent’s apartment. It seems that the attesting witnesses were unavailable to testify.

How Can an Old Will Be Admitted to Probate as an Ancient Document?

After a thorough review, the Court admitted the Will to probate as an ancient document. It was found that the Will was more than 20 years old and was found in place of natural custody and there was nothing suspicious regarding the Will. Also, the Court noted that the terms of the Will disposed of the estate in the same manner as if there was an intestate estate. Since the Will qualified as an ancient document, the Court dispensed with the testimony of the attesting witness and admitted it as an ancient document.
